Testing facilities guide and resource material now available

Testing facility applicants will soon be able to apply for an approval as a testing facility under the Road Vehicle Standards (RVS) legislation. The RVS legislation replaces the Motor Vehicle Standards Act 1989 (MVSA) and related legislation.

Under the RVS legislation, a testing facility will need to apply to the Department of Infrastructure, Transport, Cities and Regional Development and be granted an approval for test reports to be accepted as supporting evidence.

To inform stakeholders and potential applicants of the new arrangements under the RVS legislation, new guides and resources are being published.

NOTE: This material is for information only. Applications for testing facility approvals are not yet open. If you are an existing MVSA test facility, you will be notified via email when an application may be made for approval under the RVS legislation. If you are a new applicant and wish to be advised when applications are open, please email the department on [email protected] and you will be notified when applications are available.

Updated Cost Recovery Implementation Statement released

An updated draft Cost Recovery Implementation Statement (CRIS) has been released for public consultation. Submissions on the draft CRIS are invited before COB Friday 7 February 2020. The draft CRIS can be accessed here.

Interim arrangements for specialist and enthusiast vehicles and vehicles at least 25 years old

Guidance PDF: 1883 KB ReadSpeaker is available on the interim arrangements for access to specialist and enthusiast vehicles that meet the eligibility criteria under the Road Vehicle Standards legislation. This follows the Department’s announcement in September 2019 to implement measures to avoid negative consequences of delaying the commencement of certain provisions of the Road Vehicle Standards legislation.

This arrangement is in addition to the interim measure for the importation of a vehicle that is at least 25 years old as detailed in the Guidance PDF: 1349 KB ReadSpeaker.

Applications for SEV vehicles and older vehicles under these interim arrangements can be made from 10 December 2019.

Changes as a result of the delayed commencement of the Road Vehicle Standards legislation

The Australian Government recognises that some stakeholders have been adversely affected by the postponement of the commencement of the Road Vehicle Standards (RVS) legislation.

It is not the Government’s intention to unnecessarily disadvantage businesses or individuals as a result of this decision. The Government therefore intends to implement a range of measures to minimise the negative impact of the postponement on affected stakeholders.

In essence, this will entail enabling access to specialist, enthusiast and older vehicles (vehicles older than 25 years old) that would been available under the RVS legislation had it commenced. The Government has commenced working with industry representative organisations on the detail of these measures to enable practical implementation from 10 December 2019.

Extension of commencement of Road Vehicle Standards legislation

The Australian Government has extended the commencement date of the Road Vehicle Standards legislation to ensure that governments, manufacturers and importers have sufficient time to prepare for the transition to the new arrangements.

The Government will continue to work with all affected stakeholders to agree on and set a new commencement date, which will be no later than 1 July 2021. Further updates on matters related to the Road Vehicle Standards legislation will continue to be posted on this website.

The Vehicle Safety Standards Branch administers the Motor Vehicle Standards Act 1989 (the Act), develops and implements safety standards and reforms. The Branch undertakes compliance and safety investigation activities, which are fit for purpose, risk based and deliver both safety and environmental outcomes consistent with international approaches.

The Motor Vehicle Standards Act 1989 (the Act) controls the safety, environmental and anti-theft performance of all vehicles entering the Australian market for the first time—both new and used.

  • The Road Vehicle Standards Act 2018 (RVSA) introduces a Register of Approved Vehicles (RAV) which will be an online, publicly searchable, database of vehicles approved for use on Australian roads.

  • Vehicle Safety Standards (VSS) Branch administers the Motor Vehicle Standards Act 1989 (MVSA), which sets vehicle standards for all new vehicles entering the Australian market and regulates the supply to the market of used vehicles.

  • The Australian Government maintains jurisdiction over road vehicles up to the point of first supply to the Australian market (i.e. manufacture or importation). Once a vehicle has been supplied to the market, it is “in-service”. State and Territory Governments are responsible for continued regulation after this point (e.g. vehicle registration, roadworthiness and the approval of modifications to vehicles in-service).

  • The Road Vehicle Standards legislation has passed Parliament and received Royal Assent on 10 December 2018. The Road Vehicle Standards legislation will deliver a modernised regulatory framework that increases community and environmental safety, provides greater choice for consumers and removes unnecessary red tape on businesses. The main provisions of the Road Vehicle Standards Act 2018 will come into effect on 10 December 2019. A new website to support administration of the Road Vehicle Standards legislation is currently under construction.

  • The Department assists the Australian Competition and Consumer Commission in monitoring road vehicle recalls. This includes considering the need for a recall, monitoring the progresses of announced recalls and providing advice to the ACCC and suppliers conducting a recall. This page provides information for consumers, manufacturers and suppliers in relation to the Department’s involvement in road vehicle recalls.

  • Every vehicle new to Australia must meet minimum safety standards that maintain the safest possible environment for all road users and our community.

  • A Registered Automotive Workshop is a business that has been approved to import and plate up to 100 used vehicles (per vehicle category), per year. A full list of Registered Automotive Workshops is available at the RAWS website.

  • The department is responsible for monitoring and enforcing compliance with the Motor Vehicles Standards Act 1989. The department also assesses safety and non-compliance reports received from the general public, industry and other regulators and assists the Australian Competition and Consumer Commission (ACCC) in monitoring the progress of motor vehicle recalls.
